Who we are
Modi Energy ApS, Bygmarken 4A, 3650 Ølstykke, Denmark, is responsible for the personal data described on this page. If you have questions about your data, write to privacy@modi.energy.
Right now the website does two things with personal data: it shows you our pages, and it lets you join our waiting list. This page is about those two things. When Modi reaches your area and you’d like an offer, you’ll get a separate privacy notice for the next steps before we ask you for any more information.
When you join the waiting list
We ask for your first name, last name, email address and postal code. We use them to:
Confirm your signup
Email you news about Modi
Let you know when we’re getting close to your area – that’s what your postal code is for
We don’t track whether you open our emails or which links you click in them
When you sign up and confirm, our email service records the time and the IP address you used. Together with a copy of the signup form’s wording, that’s our proof that you said yes.
We do this because you’ve said yes (GDPR article 6(1)(a)). Danish law also requires your consent before we send you news by email (the Marketing Practices Act, section 10). Signing up is voluntary and doesn’t commit you to anything, but we need all four details to put you on the list.
You can change your mind at any time: use the link at the bottom of every email, go to our unsubscribe page, or write to privacy@modi.energy. Withdrawing doesn’t affect what we did before you withdrew.
When you email us
If you write to us, for example at privacy@modi.energy or marketing@modi.energy, we use your name, your email address and what you write so we can reply. We do this because we have a legitimate interest in answering you (article 6(1)(f)).
When you visit the website
Our website is hosted by Framer. Like any website, it receives what your browser sends – such as your IP address, your browser type and the page you asked for – so it can show you the page and keep the site secure.
We use Framer’s built-in statistics to count visits and see which pages are read. They don’t use cookies. Framer turns your IP address and browser details into a code using a key that is deleted every day, so we only ever see totals, never who you are.
We do this because we have a legitimate interest in running a secure website and understanding how it’s used (article 6(1)(f)).
Cookies
The website doesn’t set cookies for statistics, advertising or tracking, and it doesn’t use any cookies that need your consent. If that changes, we’ll ask you first and update this page. You can open our cookie notice again at any time via ‘Cookies’ at the bottom of every page.
Our Facebook, Instagram and LinkedIn buttons are ordinary links. Nothing is loaded from those platforms until you click, and once you’re there, their own privacy policies apply. Our unsubscribe page is hosted by Mailchimp, which handles your unsubscribe for us. Mailchimp sets its own cookies on that page, such as _mcid, which lasts a year.
Who else handles your data
Mailchimp (The Rocket Science Group LLC, part of Intuit, USA) stores the waiting list and sends our emails.
Framer (Framer B.V., the Netherlands) hosts the website and provides the visitor statistics.
Microsoft (Microsoft Ireland Operations Ltd, Ireland) hosts the inbox your emails to us arrive in.
Modi Energy Group Associated company helps us run the waiting list and our systems
They process your data on our behalf under data processing agreements and may only use it to provide their service to us. We don’t sell your data, and we don’t share the waiting list with anyone else.
Data outside the EU
Mailchimp stores data in the USA. Framer is a Dutch company, but it runs the website on Amazon Web Services, mainly in the USA, with further servers in Europe and Asia-Pacific. Microsoft may in some cases give staff or sub-processors outside the EU access to our email.
These transfers are covered by the EU-U.S. Data Privacy Framework – an adequacy decision by the European Commission – where the recipient is certified under it, and otherwise by the EU’s standard contractual clauses. Write to privacy@modi.energy if you’d like a copy of the clauses.
How long we keep your data
Waiting list: while you’re on it. If you don’t take up an offer from us, we delete your details 12 months after the offer. If we haven’t emailed you for 12 months, or we decide Modi won’t come to your area, we delete them then.
Unconfirmed signups: if you don’t confirm your signup, our email service deletes your details automatically after 60 days.
If you unsubscribe: we stop emailing you at once. We keep only your name, email address and the record of your consent, for 2 years after our last email to you, so we can show that you said yes. We do this because we have a legitimate interest in being able to document your consent (article 6(1)(f)). Then we delete them.
Emails you send us: 12 months after the matter is closed.
Visitor statistics: contain nothing that identifies you.
Server logs (such as your IP address and the page you asked for): Framer keeps them only as long as it needs to run and protect the website. Framer doesn’t publish an exact period.
Your rights
You can ask to see the data we hold about you, have it corrected or deleted, restrict how we use it, or get it in a machine-readable format. You can withdraw your consent at any time. We never make decisions about you by automated means alone.
Your right to object: you can object at any time to anything we do on the basis of a legitimate interest (article 21).
Write to privacy@modi.energy and we’ll reply within a month.
If you’re unhappy with how we handle your data, you can complain to Datatilsynet, the Danish Data Protection Agency: Carl Jacobsens Vej 35, 2500 Valby, dt@datatilsynet.dk, datatilsynet.dk.
Keeping it safe
Only the people who need your data can see it, and it’s encrypted on its way to us. If a security breach puts your data at risk, we’ll report it to Datatilsynet, and if the risk to you is high, we’ll tell you directly, as the law requires.
Changes
If we add something to the website, like a savings calculator or new statistics tools, we’ll update this page before we start using it. The date at the top shows when it last changed. If you’re on the waiting list and something important changes, we’ll email you.
